From moral damage to the protection of human dignity

Synopsis

Moral damage is a concept that partially restored the value of the individual in relation to the total protection of property under the Civil Code of 1929. However, very few authors in Mexico have recognized it as a subjective right, creating considerable confusion as part of an injury suffered by the individual or circumstances, and even feelings. This was developed in Article 1916 of the 1982 reform of the Civil Code, incorporating the theory of ad hoc personality rights with national and international developments, mainly where there was growing concern for the protection of the individual in terms of their integrity: honor, image, integrity, and identity.
